Terms of Service

These Terms of Service ("Terms") govern your access to and use of OpenCall Radar ("the Service"), operated by Gyuchul Moon, a sole proprietor based in Berlin, Germany ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Service Description

OpenCall Radar is a subscription-based web service that aggregates open calls, artist residencies, grants and prizes from publicly available sources across the web. We crawl and index third-party listings, categorize them by discipline, region, deadline and funding tier, and surface matches tailored to each subscriber's self-declared practice.

The Service is provided "as is" and is intended for working artists, curators and cultural practitioners seeking opportunities. We do not administer, fund, judge or guarantee any listed opportunity — we are a discovery layer only. Application to any listed opportunity is made directly with the respective third-party organizer under their own terms.

Access to the full feature set (unlimited listings, deadline grouping, discipline filters) requires a paid subscription. Basic browsing is available without an account.

2. Eligibility and Accounts

You must be at least 16 years old to create an account. By creating an account, you represent that you meet this requirement and that the information you provide is accurate and current. You are responsible for safeguarding your account credentials and for any activity that occurs under your account.

  • One account per person; accounts may not be shared, sold, or transferred.
  • You must provide a valid email address and respond to verification requests.
  • We may refuse registration or terminate accounts at our discretion, subject to applicable law.

3. Acceptable Use

You agree not to use the Service in any way that is unlawful, infringes third-party rights, or disrupts the Service. The following activities are expressly prohibited:

  • Scraping, crawling, or harvesting listings or any other Service data by automated means.
  • Reselling, sublicensing, syndicating or redistributing listings without explicit written permission.
  • Reverse-engineering, decompiling, or attempting to extract source code of the Service.
  • Circumventing rate limits, authentication, or paywall mechanisms.
  • Using the Service to send spam, malware, or harmful content.
  • Impersonating another person or misrepresenting your affiliation.

4. Intellectual Property

The Service — including its source code, design, trademarks, aggregated datasets, matching algorithms, and editorial curation — is owned by us and protected by applicable intellectual property laws. Nothing in these Terms grants you any license to our intellectual property beyond the limited right to use the Service for its intended purpose.

Listings displayed in the Service originate from third-party sources. All rights in those underlying listings remain with their respective organizers. We claim no ownership over third-party content and make no warranty as to its accuracy, currency, or completeness.

Any feedback, suggestions or ideas you provide to us may be used without obligation or compensation.

5. Subscriptions, Payment and Taxes

Paid plans are billed on a recurring monthly basis through our merchant of record, who processes payment, handles applicable VAT/GST, and issues invoices on our behalf. Prices are displayed inclusive of applicable taxes where legally required.

Your subscription renews automatically each billing cycle until cancelled. You may cancel at any time via your account settings (or by emailing support@opencallradar.com while account-based cancellation is being rolled out). Cancellation takes effect at the end of the current billing period; we do not offer pro-rated refunds for partial months except as required by the Refund Policy.

6. Termination

You may terminate your account at any time by using the account deletion option or by writing to support@opencallradar.com. Upon termination, your access to paid features ends at the close of the current billing period and your personal data is handled as described in the Privacy Policy.

We may suspend or terminate your account, with or without notice, if you breach these Terms, if required by law, or if we discontinue the Service. In case of suspension for cause, no refund is due for the remaining billing period.

7. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, secure, or that listings will be complete, accurate, or current. Your use of the Service is at your own risk.

8. Limitation of Liability

To the fullest extent permitted by applicable law, our total aggregate liability arising out of or related to these Terms or your use of the Service is limited to the greater of (a) the total fees you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred euros (€100).

In no event shall we be liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, loss of goodwill, or loss of data. Nothing in these Terms limits liability that cannot be excluded under mandatory applicable law (including, where applicable, consumer protection law).

9. Indemnification

You agree to indemnify and hold us harmless from any claim, demand, damages or expenses (including reasonable legal fees) brought by a third party arising out of your breach of these Terms, your misuse of the Service, or your infringement of any right of another.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of laws rules. The exclusive place of jurisdiction for all disputes arising out of or related to these Terms is Berlin, Germany, to the extent permitted by law.

For consumers residing in the European Union, the European Commission provides an Online Dispute Resolution platform available at https://ec.europa.eu/consumers/odr. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service, applicable law, or business practices. Material changes will be communicated to registered users by email at least thirty (30) days before taking effect; continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you may cancel your subscription and delete your account before the effective date.
